These terms govern the use of the app “ChatDeck” (the “App”), which is provided free of charge by Snackbits UG (haftungsbeschränkt), Heinrich-Wildung-Weg 8, 21224 Rosengarten, Germany (“Snackbits”).
1. Scope
(1) These terms apply between Snackbits and you as a user of the App.
(2) The App is provided as a direct download from snackbits.dev and is not distributed through the Mac App Store. You install it at your own responsibility; installation guidance (including the macOS security prompt) is available on the product page.
2. Licence
(1) Snackbits grants you a simple, non-exclusive, non-transferable and revocable right to use the App on the devices you use, for your own purposes.
(2) The App is provided free of charge. There is no claim to its provision, to any particular feature set or to future availability.
3. Restrictions
(1) You may not reverse engineer, decompile or modify the App beyond what is permitted by law. Mandatory statutory rights, in particular under § 69e of the German Copyright Act, remain unaffected.
(2) You may not distribute the App in modified form or as your own product, nor use it for unlawful purposes.
4. Updates
Snackbits may provide updates to the App but is not obliged to do so. Updates may change or remove individual features.
5. Third-party and open-source components
The App may contain third-party and open-source components. Their use is governed by the respective licence terms, which prevail over these terms to the extent they conflict.
6. Data protection
Information on the processing of personal data can be found in the privacy policy.
7. Warranty and liability
(1) As the App is provided free of charge, Snackbits' liability is governed by the rules on gifts under German law. Snackbits is liable for defects of quality or title only in the event of fraudulent concealment (§§ 523, 524 of the German Civil Code).
(2) Otherwise Snackbits is liable only for intent and gross negligence (§ 521 of the German Civil Code). Liability for injury to life, body or health and under the German Product Liability Act remains unaffected.
(3) The App is provided as made available. To the extent permitted by law, no warranty is given for uninterrupted availability, freedom from errors or fitness for a particular purpose.
8. Termination
You may stop using the App at any time by uninstalling it. Snackbits may discontinue the App and revoke the licence for good cause, in particular in the event of a material breach of these terms.
9. Final provisions
(1) German law applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
